Abstract

In this contribution, the author reflects on the relationship between constitutional history and comparison at the European level. This is a particularly stimulating and complex context for the application of comparative legal history. This approach can contribute to a better understanding of the unity/diversity dialectic at the root of European integration processes, and demystify the use of clichés and abstract models. Specific attention will be paid to the notions of 'constitutional heritage' and 'common constitutional traditions', with particular reference to the Italian experience.
