Abstract

Although born of international treaties, the European Union (EU) is fundamentally a legal innovation: not only does it aim to replace national law with European law within each member state, it also aims to replace international law with Union law between them. In so doing, Union law proclaims its autonomy from international law, and the EU itself replaces the member states internationally.
