Abstract

Academic freedom is not a legal concept, nor is it easily grasped by the law. It is even sometimes distorted by the law when the latter seeks to protect it through the principle of free expression (ECHR law) or Free Speech (1st Amendment in the United States). In France, academic freedom of this kind is abused by the Conseil d'Etat, which stubbornly refuses to understand university law.
