In the face of the ecological emergency, what levers can be used to make the law more effective, for both public and private players ?
International environmental law, often presented as a young law, has in fact reached a certain maturity. Born in the wake of the United Nations Conference on the Human Environment held in Stockholm in June 1972, it has since developed considerably through the adoption of numerous regional and universal agreements and instruments. Expectations are now focused on the need for a more prescriptive body of law, in addition to one based on exhortation and incitement. While progress has been made in implementing commitments, environmental protection faces the challenge of practical implementation, also known as " effectiveness ", in a context of ecological urgency. New approaches are emerging to meet this challenge, involving both public and private players. This book analyzes these developments, in particular the changing content of norms and standards, the judicialization of the application of international environmental law, and the recognition of rights to nature.
