How can we dare speak of common values in the climate of confrontation and intolerance that we know ? And how can we even conceive of the contours of a community of values beyond the diversity of cultures ? These questions cannot be answered by studying legal practices alone. It is undoubtedly at the confluence of these practices and political, philosophical and anthropological representations that a true community remains to be built. But the law could contribute to this construction, or to its consolidation, as we shall verify by starting with the apparently most accessible side : that of founding prohibitions.
The other side, fundamental rights, will be explored in 2008.
